The relationship maintained with Google is based on Art. 26 (1) GDPR (joint controllers). Within this framework, Google operates the entire IT infrastructure of the YouTube service, provides its own privacy policies, maintains an own user relationship with you (always provided that you are a registered user of YouTube) and is, together with Jägermeister, responsible for deleting illegal or inappropriate posts and contents on the website. In addition, Google as operator bears the exclusive responsibility for all questions and issues concerning the data of your user profile with YouTube that cannot be accessed by us as company.

4. Purpose of Data Processing by Jägermeister / Legal Basis
The purpose of data processing activities carried out by Jägermeister consists in rendering information on our offers, products, services, campaigns, raffles or sweepstakes, factual issues, company news and interactions with the visitors of the YouTube page as well as in responding to enquiries. The legal basis in this context is Art. 6 (1)(1)f GDPR. Data processing takes place in the interest of our public relations work and our communication with you.
5. Collection and Processing of Data / Recipients / Categories of Recipients:
The data entered by you on our YouTube page such as e.g. comments, videos, pictures, likes, public news etc. are categorically publicly available and accessible on a worldwide basis. We reserve the right to delete illegal contents, hate posts or attachments (for instance, pictures or videos) which might infringe copyrights, personality rights, penal laws or the ethics principles of Jägermeister.
Your data will be forwarded by us to third parties only if this is necessary for contract performance, if we or the third party have/has a legitimate interest in forwarding such data and if you have given your consent thereto.
In addition, data may be transmitted to third parties to the extent that we are obliged to do so by virtue of statutory regulations or due to enforceable orders issued by public authorities or courts.
By way of exception, data will be processed on our behalf by processors. Such processors will in each case be selected with care and contractually bound according to Art. 28 GDPR. The access to your data that is granted to service providers will be limited to the necessary extent.
Data can also be transmitted to third parties or to processors domiciled in non-EEA-countries. In this case we will, prior to forwarding any data, ensure that the recipient has data protection measures at an appropriate level in place. Some of the third parties involved by us have their registered office in the U.S.A. (in each case indicated in the detailed statements) and are registered under the so-called privacy shield. Data submitted by you to us are, as a rule, given on a voluntary basis. It is in exceptional cases only, e.g. if you participate in a raffle or sweepstake, that specific data must be made available (e.g. your e-mail address or your name). Without such data, we will not be able to carry out or conclude the raffle, sweepstake or contract with you.
By means of the evaluation function of YouTube Insights, as provided by Google, Jägermeister can evaluate anonymous information without obtaining any information on you as individual. Such anonymous information will be statistically evaluated in order to draw conclusions on the use of our YouTube page and to optimise our services. Examples of such information include:
• frequency of certain user activities on the page
• number of page visits and likes
• reach
• post engagement / engagement rate
• number of subscribers.
We have only limited influence on this function and cannot disable it. But we pay attention that no additional optional statistics are made available to us.
When accessing the contents of our YouTube page, information on user behaviour, including personal data, will automatically be forwarded to and used by Google.
Please be aware that it cannot be ruled out that Google makes use of your profile and behaviour data, for instance in order to evaluate your habits, personal relationships, preferences etc.
Jägermeister has no control and no knowledge as to the kind of data collected by Google and as to how such data are used by Google. Where we are actually able to exert influence and to parametrise data processing activities, we will, within the framework of the possibilities available to us, work towards a handling of data by Google according to data protection requirements.

The data protection officer of Google may be contacted here. Settings options for personal data processing activities by Google can, inter alia, be found in your YouTube profile under the menu item ‘settings’and in your Google account.
6. Retention Period / Criteria for Determining the Retention Period:
All personal information submitted by you in case of enquiries by means of a secure message will be deleted by us or securely anonymised no later than 90 days after having sent you our final response, unless a retention is necessary for any other reasons. We decided to keep the data for a period of 90 days, because you as our customer might contact us again in the same matter after having received our response and we must in such case refer to our prior correspondence. All public posts made by you on YouTube will continue to appear in the timeline view for an unlimited period, unless we delete them due to an update of the underlying topic or an infringement of legal provisions or of our guidelines or you delete the post yourself. With respect to a deletion of your data by Google itself we have no control at all. To this end, the Google privacy policies for YouTube are applicable in addition.
7. Your Rights as Data Subject
Upon request, you are according to Art. 15 (1) GDPR entitled to obtain information on your personal data stored with Jägermeister without charge. Apart from that, you may in case of a fulfilment of the statutory prerequisites request the rectification (Art. 16 GDPR), erasure (Art. 17 GDPR) and restriction of the processing (Art. 18 GDPR) of your personal data. To the extent that data processing is based on Art. 6 (1) e) or f) GDPR, you are according to Art. 21 GDPR entitled to object. If you object to a processing of data, the respective data will no longer be processed, unless Jägermeister can demonstrate compelling legitimate grounds for a continued processing which override you interest in an objection. If the processed data were made available by yourself, you have a right to data portability pursuant to Art. 20 GDPR. To the extent that data processing is based on a consent granted according to Art. 6 (1) a) or Art. 9 (2) a) GDPR, you may withdraw such consent at any time with effect for the future, but such withdrawal will not have any impact on the legality of data processing activities performed up to that time. With respect to the aforementioned cases or in case of any further questions or complaints, please contact our data protection officer either in writing or by e-mail. In addition, you are entitled to lodge a complaint with a data protection supervisory authority of the Federal land where you reside or the controller has its registered office. You are kindly asked to note that, as a rule, you must assert your rights also towards Google because only Google can access your profile data.
